On July 10, 2012, a jury awarded a plaintiff a verdict for breach of contract damages and attorney's fees. The plaintiff claimed he had entered into an oral contract with an investment company and its president and owner to find investors for a company that was funding a land deal. If the investors received a return on their investment, then the plaintiff was to receive a commission. The plaintiff found investors, and the investors received a return on their investment. However, the plaintiff did not receive a commission.
The winning arguments.
The oral contract at issue was formed in recorded phone conversations between the plaintiff and the investment company's president and owner. Plaintiff's counsel presented these conversations to the jury at trial. Plaintiff's counsel maintained that these conversations constituted a binding and enforceable oral contract, which had been breached by the defendants. After a short deliberation, the jury returned a verdict in favor of the plaintiff.
