Plaintiff insured and insurer recover favorable settlement in maritime action.
Favorable plaintiff settlement.
In May 2010, a favorable settlement for the plaintiff pipeline company and its insurer was entered into at mediation in a maritime tort action arising from a MODU that broke loose during Hurricane Rita and drifted into shallow water, dredging up two undersea pipelines and shutting in three undersea gas wells. Donato, Brown & Pool served as plaintiffs' counsel for the pipeline company and Certain Underwriters at Lloyd's, London.
The defendant drilling company owned and operated an oil rig in the Gulf of Mexico. During Hurricane Rita, the defendant's oil rig broke loose and allided with the plaintiff pipeline company's offshore natural gas pipeline, rupturing the pipeline in the process. At mediation, Donato, Brown & Pool obtained a favorable settlement for the plaintiff pipeline company and its insurer.
