In June 2011, a favorable settlement was entered into for the plaintiffs in a product defect suit involving a failed fuel injection system on a V16 diesel motor, which ignited a fire and caused the destruction of five frac trucks at a frac job on a gas well. Donato, Minx, Brown & Pool served as plaintiff's counsel for BJ Services Company and Certain Underwriters at Lloyd's, London.
The plaintiff insured was performing a hydraulic fracturing job in South Texas when a large fire suddenly broke out, spreading throughout the equipment and leading to the eventual destruction of five hydraulic fracturing units. Plaintiff's counsel asserted that the cause of this well head fire was a defective fuel injection system, which was manufactured and sold by the defendants. Donato, Minx, Brown & Pool obtained a favorable settlement for the plaintiff insured and the insurer.
