The fire began when a pipe elbow ruptured at a Citgo refinery in suburban Chicago, causing hot oil to escape, auto-igniting and causing a fire that substantially destroyed the refinery’s crude oil processing unit. A post-accident investigation determined that the Babcock & Wilcox Company manufactured the eight inch elbow. Donato, Minx, Brown & Pool sought recovery for property damage and business interruption.
The six week trial was heard in Cook County, Illinois and resulted in the largest verdict ever rendered in Cook County and the second largest non-class action verdict in the State of Illinois. The jury deliberated for eight hours before returning a verdict.
